Terms of Service

These Terms of Service ("Terms") govern your use of the RespondersAI LLC mobile applications, including EMS Drug Reference and EMS Protocol Reference (collectively, the "Apps"), and the RespondersAI website located at respondersai.com (the "Site"). By downloading, installing, or using any App, you agree to these Terms. If you do not agree, do not use the Apps.

RespondersAI LLC is a limited liability company organized under the laws of the State of New York.

Important — Read Before Use: The Apps are reference tools for informational purposes only. They are not medical devices, are not FDA-cleared or approved, and are not a substitute for your professional training, your agency's protocols, or your clinical judgment. Never rely solely on App output to make patient care decisions.

1. Informational Use Only — Not Medical Advice

The Apps provide reference information to assist trained emergency responders. The content, including any AI-generated output, is provided for informational and educational purposes only and does not constitute medical advice, diagnosis, or treatment recommendations.

AI-generated results may be incomplete, outdated, or inaccurate. You must independently verify all information against authoritative clinical sources, your agency's protocols, and medical direction before acting on it. App output must not override your professional clinical judgment.

RespondersAI LLC is not a healthcare provider and does not practice medicine. No provider-patient or provider-responder relationship is created by your use of the Apps.

2. Not a HIPAA-Covered Entity

RespondersAI LLC is not a HIPAA-covered entity and the Apps are not HIPAA-compliant tools. You must not enter, photograph, or otherwise input any protected health information (PHI) or personally identifiable information (PII) (including patient names, dates of birth, addresses, or medical record numbers) into a medication lookup query (a "Lookup"), which may be transmitted to a third-party AI provider for processing. You are solely responsible for ensuring your use of the Apps complies with all applicable privacy laws and your agency's policies.

Exception for the ID/Insurance Card feature. The prohibition in the preceding paragraph does not extend to the ID/Insurance Card feature in EMS Drug Reference (Pro), which is provided for the express purpose of capturing and storing an image of a patient's ID or insurance card. Images captured with that feature are stored in encrypted form on your device only, are never transmitted by RespondersAI LLC to its servers or to any AI provider, and are never analyzed. See the EMS Drug Reference section under "App-Specific Terms" below and "Saved photos (Pro)" in the RespondersAI LLC Privacy Policy.

3. FDA Regulatory Status

The Apps are intended to provide general clinical reference information to licensed or certified emergency responders and are not intended to replace clinical judgment or to diagnose, cure, treat, or prevent any disease or medical condition. The Apps are not FDA-cleared or FDA-approved medical devices. RespondersAI LLC does not make diagnostic or treatment claims.

4. Eligibility and Acceptable Use

The Apps are designed primarily for trained emergency medical, fire, and law enforcement professionals and must be used only within the scope of the user's training and applicable protocols. You agree not to:

Use the Apps as the sole basis for any patient care decision
Input PHI, PII, or any patient-identifiable information into a Lookup, except as permitted under Section 2
Reverse engineer, decompile, or attempt to extract the source code of the Apps
Use the Apps for any unlawful purpose
Resell, sublicense, or redistribute the Apps or their content

5. Subscription and In-App Purchases

Some Apps offer a free tier together with one or more optional paid tiers available via the Apple App Store. The specific features, limits, and pricing of each tier are displayed within the applicable App at the time of purchase. App-specific details are described in the per-app section below.

Billing and cancellation. All billing is handled by Apple through your Apple ID. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period. To cancel, visit your Apple ID subscription settings. RespondersAI LLC does not process payment information directly.

No refunds from RespondersAI LLC. Because all payments are processed by Apple, RespondersAI LLC has no ability to issue refunds. Refund requests must be submitted to Apple in accordance with Apple's standard refund policy.

6. AI-Generated Content

Certain features of the Apps use third-party artificial intelligence services to generate responses. AI-generated content is produced by probabilistic models and may contain errors, omissions, or outdated information. RespondersAI LLC does not warrant the accuracy, completeness, or fitness for any particular purpose of AI-generated output. You assume all risk associated with reliance on AI-generated content.

7. Intellectual Property

All content, branding, software, and materials in the Apps and on the Site are the property of RespondersAI LLC or its licensors and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Apps for their intended purpose. No other rights are granted.

You retain any rights you hold in content you submit through the Apps. You grant RespondersAI LLC a limited, non-exclusive, royalty-free, worldwide license to store, reproduce, and use content you submit solely for the purposes of operating, analyzing, and improving the Apps, as described in the Privacy Policy. You represent that you have the right to submit any content you submit and that your submission of it does not violate any law, any right of a third party, or your agency's policies.

8. Disclaimer of Warranties

THE APPS AND SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. RESPONDERSAI LLC DOES NOT WARRANT THAT THE APPS WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. YOUR USE OF THE APPS IS AT YOUR SOLE RISK.

Some jurisdictions do not allow the exclusion of implied warranties, so one or more of the exclusions above may not apply to you.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RESPONDERSAI LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, PROPERTY DAMAGE, LOSS OF DATA, OR LOSS OF REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APPS, EVEN IF RESPONDERSAI LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL RESPONDERSAI LLC'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY DOLLARS ($50.00), WHICHEVER IS GREATER.

Nothing in these Terms excludes or limits liability for gross negligence, willful misconduct, or any other liability that cannot be excluded or limited under applicable law. Some jurisdictions do not allow the limitation or exclusion of certain damages, so one or more of the limitations above may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless RespondersAI LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Apps, your violation of these Terms, your violation of any applicable law or regulation, or your input of PHI or PII into a Lookup in violation of Section 2 of these Terms.

11. Apple App Store — Additional Terms

If you downloaded an App from the Apple App Store, the following also apply:

These Terms are between you and RespondersAI LLC only, not with Apple Inc. Apple has no obligation to provide maintenance or support for the Apps.
Apple is not responsible for any claims relating to the Apps, including product liability claims, consumer protection claims, or intellectual property infringement claims.
In the event of any failure of an App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any). Apple has no other warranty obligation with respect to the Apps.
Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you.
Apple is not responsible for addressing any claim by you or a third party relating to an App's failure to conform to any legal or regulatory requirement.
You represent that you are not located in a country subject to a United States Government embargo or designated as a terrorist-supporting country, and that you are not listed on any United States Government list of prohibited or restricted parties.
Your use of the Apps must comply with the Apple App Store Terms of Service.

12. Modifications to Terms and Apps

RespondersAI LLC reserves the right to modify these Terms or the Apps at any time. Updated Terms will be posted on the Site with a revised "Last updated" date. Where a modification is material, RespondersAI LLC will provide notice within the Apps or by email before the modification takes effect. Your continued use of the Apps after a modification takes effect constitutes your acceptance of the updated Terms. You should review this page periodically.

13. Termination

RespondersAI LLC may suspend or terminate your access to the Apps or the Site at any time, with or without notice, if you violate these Terms or if RespondersAI LLC reasonably believes that your use of the Apps creates a risk of legal liability for RespondersAI LLC or for another user. You may stop using an App at any time by deleting it from your device. Deleting an App does not cancel a subscription, which must be cancelled through your Apple ID subscription settings as described in Section 5. Sections 1 through 3, 7 through 10, and 14 through 16 survive any termination.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any dispute arising under or related to these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in New York, and you consent to personal jurisdiction in those courts.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

16. General

These Terms, together with the Privacy Policy, constitute the entire agreement between you and RespondersAI LLC regarding the Apps and the Site, and supersede any prior agreement or understanding on that subject. No failure or delay by RespondersAI LLC in exercising any right under these Terms operates as a waiver of that right, and no waiver of any provision is effective unless made in writing. You may not assign or transfer these Terms without the prior written consent of RespondersAI LLC; RespondersAI LLC may assign these Terms in connection with a merger, acquisition, or sale of assets. Notices to you may be given within the Apps or by email, and notices to RespondersAI LLC must be sent to the address in Section 19.

17. App-Specific Terms

EMS Drug Reference — App Store

Free tier. EMS Drug Reference is available at no charge with a limited number of AI-powered lookups per day. Current daily limits are displayed within the App and are subject to change.

Pro subscription. An optional Pro subscription unlocks unlimited lookups and enables encrypted local storage of your lookup history, saved photos, offline queuing, and PDF handoff export. Available on a monthly or annual basis via the Apple App Store. Pricing is shown in the App at the time of purchase.

Device permissions. EMS Drug Reference requests camera access to photograph medications and, with a Pro subscription, to save the resulting photos or a separate reference photo (such as a license or insurance card) to your device; microphone and speech recognition permission for voice input; and, with a Pro subscription, Face ID/Touch ID permission to protect saved reference photos and to confirm your identity before including photos in a shared PDF export. You may revoke any permission at any time in iOS Settings.

EMS Protocol Reference — App Store

Free tier. EMS Protocol Reference is available at no charge with access to a base set of protocol content and features.

Premium options. Optional paid upgrades are available to unlock additional content (such as protocols for multiple states or regions) on a one-time or subscription basis via the Apple App Store. Available upgrades and pricing are displayed within the App.

Protocol content. Protocol content available through EMS Protocol Reference may originate from publicly available state or agency EMS protocols. Ownership of such content remains with the respective issuing authority. RespondersAI LLC makes no claim of ownership over third-party protocol content and presents it for informational reference only.

Device permissions. EMS Protocol Reference requests microphone and speech recognition permission for voice input. Voice input uses Apple's speech recognition services to convert spoken words to text; audio is not stored by RespondersAI LLC. You may revoke this permission at any time in iOS Settings.

All original content, software, branding, and materials created by RespondersAI LLC are copyright © 2026 RespondersAI LLC. All rights reserved. Unauthorized reproduction, distribution, or modification of any RespondersAI LLC content is prohibited. Third-party content, including protocol materials sourced from public agencies, remains the property of its respective owners.
